Written by Daniel Horowitz

To this day, courts insist you have no right to bodily autonomy when it comes to coerced vaccination and forced masking. They cite the “police powers” of the state as justification. But when the state uses those same powers to regulate public nudity or sexually explicit drag shows in front of children, suddenly the judiciary rediscovers the First Amendment.

In 2023, Florida Gov. Ron DeSantis signed SB 1438, a commonsense law that barred businesses from knowingly admitting children to “adult live performances.”… Continue Reading

Written by Robert Knight

About half of America’s 50 states seem to care more about children’s well-being than about being sufficiently “woke.”

That’s why they don’t embrace gender insanity and instead ban puberty-blocking drugs, cross-sex hormones and irreversible surgery for minors.

The U.S. Supreme Court this past week heard arguments on Tennessee’s law barring trans treatments for minors.

Some justices blew wide holes in the case for creating trans kids. But it’s by no means a lock that this allegedly conservative court will restore sanity on this issue.… Continue Reading

The U.S. Supreme Court works in strange and mysterious ways.

It can enrage the progressive left with a solidly constitutional ruling like Dobbs v. Jackson Women’s Health Organization (2022), which overturned Roe v. Wade and sent the issue of abortion to the states.

But it can also amaze and frustrate conservatives, as when it refused before and after the 2020 election to review Pennsylvania officials’ unconstitutional changes to election procedures.

“We failed to settle this dispute before the election and thus provide clear rules.… Continue Reading

During his 2005 confirmation hearings, Chief Justice John Roberts compared the role of the U.S. Supreme Court to that of an umpire calling balls and strikes. But what happens when the umpire allows one team more at-bats than the other? Once again, the much-vaunted conservative U.S. Supreme Court is a one-way ratchet for left-wing litigation. Some things never change.

When Donald Trump was president, not a single major administrative policy went unchallenged by the officiously litigious left-wing legal movement.… Continue Reading

Six of the nine U.S. Supreme Court justices have been appointed by Republicans, yet red states are now being prevented by federal courts from keeping boys out of girls’ bathrooms. What was the point of the generation-long battle for control of the high court?

The U.S. Supreme Court is under all-out attack. Recent headlines reveal a concerted effort to manufacture an “ethics” scandal about Justice Clarence Thomas, the Court’s leading conservative and one of the foremost defenders of religious liberty. Justice Neil Gorsuch has also been the target of this smear campaign.

Democrats in Congress, along with their allies in left-wing radical groups and the media, are bringing back calls for radical court “reform.” A constitutionally suspect “judicial ethics” bill was introduced and the U.S.… Continue Reading

One thing we learned from the courts throughout COVID is that there is almost nothing state and local government officials cannot do to your life, liberty, and even body under the guise of public health. Yet for years, these same courts have placed limitations on the ability of government officials to pray in public when nobody is coerced to join them. Pagan groups have been empowered to shake down cash-strapped local governments in cumbersome lawsuits over the issue of public prayer, and Justice Clarence Thomas is finally calling for an end to this insanity.… Continue Reading

Have you ever boarded an airliner during a rainstorm and then, minutes later, broken through the clouds to bright sunshine? It can be quite startling. People blink like moles emerging from their burrow.

The sun has been there all along, of course, but when we’re unable to see it from below we can forget how bright it can be.

That’s how believers view this world under God. No matter how bad things get, there is a Creator God who loves us and inspires hope in this life and the next.… Continue Reading

The U.S. Supreme Court heard arguments this week on whether to overturn its Roe v. Wade decision of 48 years ago that legalized abortion.

It is considering a Mississippi law that bans abortions after 15 weeks – well before the established point of fetal “viability” at around 24 weeks. Many pro-life leaders hope the nation’s highest court will use this opportunity to reverse Roe v. Wade to protect unborn children.

Chief Justice John Roberts and Justice Brett Kavanaugh, both nominated by Republican presidents, have both written absurd opinions on abortion laws.

The case of Dobbs v. Jackson Women’s Health, which the U.S. Supreme Court will hear this year, could give them an opportunity to redeem themselves.

At issue in this case is a Mississippi law that bans most abortions after a baby’s 15th gestational week. The question: Can a state prohibit doctors from killing unborn babies who are not yet old enough to survive outside the womb?… Continue Reading

Democrats never have any doubts about their court nominees. They know with certainty that once their picks are on the court, they will be willing to do anything in a real case to interpret the U.S. Constitution the way they see it. They will rule with the party’s preferred political outcomes regardless of past precedent or the plain meaning of the Constitution. There is no reason why conservatives cannot have that same confidence that GOP nominees will rule on the side of the original meaning of the U.S.… Continue Reading

“Separation of church and state.” There may be no reference to, inference of, insinuation of, or display of religion anywhere in any government operation or public school, even if there is no coercion to participate in any Christian event or prayer. That is enshrined in every clause of the U.S. Constitution.

That is essentially what the Left has been telling us for years, and those principles have been enforced to varying degrees in many lower courts and, intermittently, even by the U.S.… Continue Reading

That was the late Joe Sobran’s ironic take mostly on the courts’ blatantly unconstitutional usurpations over the past few decades.

The most powerful evidence that federal judges have eclipsed the other branches of government is the circus surrounding President Trump’s nomination of Brett Kavanaugh to the U.S. Supreme Court. This should not be as big a deal as it is.

If you missed it, dozens of screaming women, some costumed, were dragged from the confirmation hearings.… Continue Reading

The U.S. Supreme Court’s longest serving justice announced his retirement shortly after casting the deciding vote on a string of decisions that were seen as wins for the conservative side of the bench. Kennedy’s stepping down didn’t come as a surprise. There have long been rumors in Washington that he was considering hanging up his robe. With a Republican-controlled Congress and White House, the timing couldn’t be better, so as to ensure his seat would be filled with someone from the right side of the ideological spectrum.… Continue Reading

Year two of the President Donald J. Trump presidency doesn’t technically begin until later this month, but a quick look back at 2017 and ahead to 2018 is in order.

First, 2017. Many of those who have been working in the political trenches for a long time welcomed Trump’s candidacy and presidency. Why? Because we had witnessed close-up how so many good conservative leaders were failing decade after decade to successfully advance conservative policies.… Continue Reading

There have been a whole lot of news distractions since President Donald J. Trump took office. Some of them he brought upon himself, but most are ploys of the liberal media and part of the far left’s agenda to cripple his presidency.

Daily media obsessions with things like Russia have hidden a very positive result of the Trump election. In his first 200 days, President Trump has nominated 44 federal judges including U.S.… Continue Reading

U.S. Senators Chuck Schumer and Patrick Leahy claimed that newly confirmed U.S. Supreme Court Justice Neil Gorsuch was not in the “legal mainstream.” They were referring to the “living Constitution” approach to constitutional interpretation. That interpretative approach, still thriving today and embraced by the liberal left, says that the U.S. Constitution should be a document that judges regard as one “that evolves, changes, over time, and adapts to new circumstances, without being formally amended.”… Continue Reading

Generally, the first 50 days of the Trump Administration have been an absolute joy to watch. The media and the Left have been apoplectic as President Donald J. Trump largely honors his campaign promises and does exactly what he said he would do. Truthfully, Trump has been everything we hoped he would be and more.

Still, that’s not to say there haven’t been some disappointments. Here are four things I like and two things I dislike from the first 50 days:

Written by Daniel Horowitz

This week, President Donald Trump fulfilled his promise to nominate a very qualified and intelligent conservative judge. Neil Gorsuch is likely a very good pick. However, given the past history, the enormous post-constitutional pressure even in some circles of the conservative legal movement, and so much terrible court precedent, it is yet to be determined if Gorsuch has the resolve to not get sucked into the swamp.

This point was best encapsulated in a statement from U.S.… Continue Reading
