The U.S. Supreme Court does not hand down 8–1 rulings very often, especially on culture-war issues. So when this Court—this Court—lands almost unanimously on one side, it’s an earthquake.

Justices John Roberts, Elena Kagan, Sonia Sotomayor, AND the Court’s conservatives all converged to say a particular law in Colorado was unconstitutional. Cue the earthquake.

The case has to do with “conversion therapy.” The term has been deceitfully used by LGBTQ proponents for many years to equate it with a barbaric practice.… Continue Reading

Written by David E. Smith

The U.S. Supreme Court delivered an important decision this week by ruling that Illinois Republican Congressman Mike Bost (R-Murphysboro) has legal standing to challenge Illinois’ controversial mail-in ballot law. The 7–2 decision in Bost v. Illinois State Board of Elections doesn’t decide whether the law itself is constitutional — but it opens the courthouse door for candidates to hold election rules accountable in court.

At issue is an Illinois statute that allows mail-in ballots postmarked by Election Day to be counted up to two weeks afterward.… Continue Reading

President Donald Trump is in a public wrestling match with Chief Justice John Roberts and some of the federal judiciary.

Along with congressional lawmakers, Mr. Trump has called for impeaching several U.S. district judges who have issued orders blocking his administration from carrying out key policies.

Mr. Roberts says this imperils the independence of the judiciary, without which abuses of power could become routine.

Mr. Trump says that this is nonsense, that these judges have gone well beyond their authority to hear cases and are trying to dictate national policy.… Continue Reading

Within hours of her being announced as President Biden’s presumed replacement as the Democratic nominee, Vice President Kamala Harris’ moderate makeover began.

Journalists reflexively began gushing over her “historic” candidacy and centrist views.

The love bombing and sheer dishonesty is a replay of 2020, when she ran for vice president as a supposed moderate.

The facts loudly spoke otherwise. As a U.S. senator from California from 2017 to 2021, she had a more leftist voting record even than socialist U.S.… Continue Reading

During his 2005 confirmation hearings, Chief Justice John Roberts compared the role of the U.S. Supreme Court to that of an umpire calling balls and strikes. But what happens when the umpire allows one team more at-bats than the other? Once again, the much-vaunted conservative U.S. Supreme Court is a one-way ratchet for left-wing litigation. Some things never change.

When Donald Trump was president, not a single major administrative policy went unchallenged by the officiously litigious left-wing legal movement.… Continue Reading

There were more than a few storylines to track after one of the most intransigent liberals in the history of the U.S. Supreme Court, Stephen Breyer, announced he would be stepping down at the end of this term.

First, the timing of the announcement seemed suspect. Justices have historically waited much later in the term to declare such an intent (Kennedy, Souter, O’Connor). That early timing led to widespread speculation that Breyer likely gave the White House the courtesy of a wary heads-up to avoid them being taken off guard and allow them to give a full and proper vetting of potential replacements.… Continue Reading

The U.S. Supreme Court heard arguments this week on whether to overturn its Roe v. Wade decision of 48 years ago that legalized abortion.

It is considering a Mississippi law that bans abortions after 15 weeks – well before the established point of fetal “viability” at around 24 weeks.
James Madison once wrote, “Government is instituted to protect property of every sort” and that “conscience is the most sacred of all property.” Yet just before July 4 weekend, the U.S. Supreme Court, by denying an appeal in an important religious liberty case, has essentially abrogated both property and conscience rights, as well as the right to use one’s own property in accordance with deeply held religious beliefs. So much for self-evident truths, inalienable rights, and the institution of government to secure these rights.… Continue Reading

Chief Justice John Roberts and Justice Brett Kavanaugh, both nominated by Republican presidents, have both written absurd opinions on abortion laws.

The case of Dobbs v. Jackson Women’s Health, which the U.S. Supreme Court will hear this year, could give them an opportunity to redeem themselves.

At issue in this case is a Mississippi law that bans most abortions after a baby’s 15th gestational week. The question: Can a state prohibit doctors from killing unborn babies who are not yet old enough to survive outside the womb?… Continue Reading

Six months ago, the idea of expanding the size of the U.S. Supreme Court was side-stepped by presidential candidate Joe Biden, and the issue seemed to wane. But now, “court packing” has surfaced once again—and in two forms. The first is an executive order from President Biden creating a commission to study possible reforms of the U.S. Supreme Court.
As the American political world gears up for what promises to be one of the most acrimonious, bitter, and embarrassing confirmation hearings in the history of the federal judiciary, I’m curious if anyone has picked up on a common theme when it comes to these reputation desecrations we call senatorial “advise and consent.”

Out of sheer curiosity I conducted an informal, and extraordinarily unscientific survey of a small group of 5 politically aware colleagues and friends.… Continue Reading

“Separation of church and state.” There may be no reference to, inference of, insinuation of, or display of religion anywhere in any government operation or public school, even if there is no coercion to participate in any Christian event or prayer. That is enshrined in every clause of the U.S. Constitution.

That is essentially what the Left has been telling us for years, and those principles have been enforced to varying degrees in many lower courts and, intermittently, even by the U.S.… Continue Reading

Written by Daniel Horowitz

Our political system regards the U.S. Supreme Court as superior to the other two branches of government. Why then doesn’t the high court wield its supremacy over its own branch and rein in the lawlessness of the lower courts? Shouldn’t it uproot a growing power grab by the lower courts that are issuing nationwide injunctions over broad policies? Justice Clarence Thomas seems to think so.

In Thomas’ concurrence in the “travel ban” case, he spends just one paragraph dealing with the merits of the case.… Continue Reading

In the case of King v. Burwell, decided by the U.S. Supreme Court in June of 2015, President Barack Obama won the day by convincing six justices that Obamacare would collapse if he lost. The case involved the so-called “individual mandate,” which imposes a financial penalty on those who neglect to buy health insurance. To many observers, the wording of Affordable Care Act seemed to impose the financial penalty only in states where a state exchange had been set up, not in states where the federal exchange operated by default.… Continue Reading

Some of these things should probably be taken with a grain of salt — “Only Rosie O’Donnell” comes to mind — but some deserve to be analyzed more closely.

Here’s an example. Remember Trump’s discussion about U.S. Supreme Court Justices back in August with Bloomberg Politics? Mark Halperin asked Trump, “Is there someone out there today who isn’t on the [Supreme Court], but say, this is the kind of person I would consider for the court?… Continue Reading

Now we know who the masters are: the black-robed dictators of the U.S. Supreme Court. And we know who the slaves and the serfs are: you and me.

Written by Bryan Fischer

The judicial tyrants of the U.S. Supreme Court, headed by chief oligarch John Roberts, have abandoned the Constitution, reason, and their oath of office by trashing the plain language of ObamaCare to reach an illogical, irrational, and judicially abominable result.

This 6-3 ruling is a juristic catastrophe.… Continue Reading

It’s often said, “Be careful what you wish for – you just might get it.”

Democrats got it all right.

U.S. Supreme Court Chief Justice John Roberts – once counted among the constitutional originalists on the high court – has granted President Barack Obama’s supreme wish. By inexplicably siding with the court’s left wing and upholding the president’s signature achievement – government-run socialized health care – Roberts has given Democrats a shiny election-year package adorned with a judicial-activist bow.… Continue Reading
