<p>When lawyer <strong>Sarah Weddington</strong> stood up in the U.S. Supreme Court on Oct. 11, 1972, to present the pro-abortion argument in the case of <em>Roe v. Wade</em>, she was legalistically careful in the language she used to describe whom exactly an abortion aborted.</p>
<p>She avoided normal human terms like &#8220;unborn child&#8221; or &#8220;baby&#8221; — and, most importantly, &#8220;person.&#8221; She preferred &#8220;fetus.&#8221;</p>

<p>Our political system regards the U.S. Supreme Court as superior to the other two branches of government. Why then doesn’t the high court wield its supremacy over its <em>own</em> branch and rein in the lawlessness of the lower courts? Shouldn’t it uproot a growing power grab by the lower courts that are issuing nationwide injunctions over broad policies? Justice <strong>Clarence Thomas</strong> seems to think so.</p>

<p>This week, President <strong>Donald Trump</strong> fulfilled his promise to nominate a very qualified and intelligent conservative judge. <strong>Neil Gorsuch</strong> is likely a very good pick. However, <a href="https://www.conservativereview.com/commentary/2017/01/what-conservatives-want-in-a-supreme-court-justice">given the past history</a>, the enormous post-constitutional pressure even in some circles of the conservative legal movement, and so much terrible court precedent, it is yet to be determined if Gorsuch has the resolve to not get sucked into the swamp.</p>
